Nowship Terms of Service

These Terms of Service apply to the Nowship website, online bookings, shipping coordination, containerized shipment services, packing systems, Kübox containers, carrier-provided value protection, custom services, and related services made available through Nowship.
By using the Nowship website, placing an order, booking a shipment, purchasing a container or packing system, selecting carrier-provided value protection, submitting shipment information, or tendering a shipment for service, you agree to these Terms of Service and all applicable Nowship policies.
These Terms should be read together with the Nowship Shipping Policy, Return, Credit & Cancellation Policy, Prohibited Items Policy, Packing Requirements, Privacy Policy, and any carrier terms, carrier service guides, tariffs, bills of lading, waybills, air waybills, customs rules, or other transportation rules that apply to your shipment.
1. Nowship Is a Shipping Platform
Nowship is a platform that helps customers access shipping services, containerized shipping solutions, carrier options, shipment coordination, packing systems, carrier-provided value protection, customs-related shipment support, and related service tools.
Nowship is not a motor carrier, air carrier, ocean carrier, household goods mover, moving company, freight forwarder, customs broker, trucker, insurer, warehouseman, or in-home packing company.
Transportation is performed by third-party carriers, service providers, agents, brokers, pickup providers, delivery providers, customs brokers, warehouses, or other transportation-related parties. These parties operate independently from Nowship and may apply their own rules, service limits, tariffs, claims procedures, liability limits, prohibited item rules, and delivery requirements.
Nowship may help arrange, coordinate, book, support, document, or manage parts of the shipment process, but Nowship does not physically transport shipments unless a separate written agreement expressly states otherwise.
2. Customer Responsibility
The customer is responsible for the shipment, including the accuracy of all shipment information, the condition of the contents, the legality of the contents, the packing of the contents, and the readiness of the shipment.
The customer is responsible for:

Selecting the correct service

Selecting the correct container or packing system

Entering accurate origin and destination information

Entering accurate shipper, recipient, and contact information

Providing accurate shipment descriptions
-
Providing accurate declared values
-
Providing accurate weights and dimensions
-
Properly packing, sealing, labeling, and preparing the shipment
-
Complying with carrier rules
-
Complying with customs rules
-
Complying with all applicable laws
-
Paying all charges, fees, surcharges, duties, taxes, penalties, storage costs, correction fees, return fees, and destination charges
Nowship may provide packing guidance, service guidance, online tools, product descriptions, templates, or customer support. Any guidance provided by Nowship is for general assistance only and does not transfer responsibility for packing, contents, compliance, documentation, or shipment readiness from the customer to Nowship.
3. Self-Packed Shipments
Unless a written custom service agreement states otherwise, Nowship services are designed for self-packed shipments.
The customer is responsible for packing all items so they can withstand normal transportation handling, including movement, vibration, compression, stacking, conveyor handling, hand handling, vehicle movement, facility handling, weather exposure during transfer, and ordinary carrier operations.
Items must be packed so they do not shift, strike each other, touch the container walls without protection, puncture the container, leak, break through the container, or damage other shipments, property, equipment, or personnel.
Fragile, sensitive, high-value, electronic, artwork, equipment, glass, ceramic, medical, scientific, prototype, or specialty items may require enhanced packing. Poor packing, insufficient cushioning, overloading, item-to-wall contact, loose contents, improper sealing, unsuitable cushioning, or failure to follow packing instructions may reduce or eliminate claim eligibility.
4. Containers, Kübox Containers, and Packing Systems
Nowship may provide new containers, Kübox containers, packing systems, packing supplies, labels, or related shipment materials.
Containers and packing supplies are not ordinary returnable retail goods. Once ordered, fulfilled, delivered, assembled, marked, labeled, used, damaged, or placed into service, they are not returnable and are not eligible for refund. Any credit, if available, is governed by the Nowship Return, Credit & Cancellation Policy.
Nowship may refuse to ship, cancel, delay, re-rate, or require correction for any shipment that exceeds the stated weight limit, dimensional limit, service limit, container limit, packing requirement, destination restriction, or carrier requirement.
5. Custom Services
Nowship may offer custom services, including special shipment coordination, project-based shipping, unusual shipment handling, documentation support, account-based service terms, custom pricing, non-standard pickup or delivery coordination, special container configurations, commercial shipment support, or other services approved by Nowship in writing.
Custom services may include standard booking clauses unless a written custom service quote, invoice, agreement, or approval states otherwise.
Custom service fees, custom orders, special arrangements, project work, documentation work, coordination time, and any services already started or completed are non-refundable. If a custom service is cancelled, changed, reduced, or not fully used, Nowship may issue a site credit or partial credit only when an unused service portion remains and only when approved by Nowship.
6. Carrier Rules Apply
All shipments are subject to the rules, tariffs, service guides, conditions of carriage, bills of lading, air waybills, waybills, operating procedures, dimensional rules, weight limits, prohibited item rules, claims rules, and liability limits of the carrier or service provider that handles the shipment.
Carrier rules may limit or exclude liability for loss, damage, delay, misdelivery, non-delivery, customs delay, weather delay, operational delay, indirect loss, consequential loss, and certain categories of goods.
By booking through Nowship, the customer authorizes Nowship to select, book, coordinate with, communicate with, and use third-party carriers or service providers as needed to perform or support the shipment.
Nowship does not guarantee any specific carrier, route, vehicle, aircraft, facility, service method, transit time, pickup time, delivery time, or delivery attempt unless stated in a written custom service agreement.
7. Rates, Billing, and Additional Charges
Prices shown at checkout are based on the information provided by the customer and the service selected at the time of booking.
Additional charges may apply if the shipment information is inaccurate, incomplete, changed, corrected, re-rated, remeasured, reweighed, redirected, returned, delayed, refused, held, inspected, stored, or handled as an exception shipment.

The customer authorizes Nowship to charge the original payment method, request payment, or invoice the customer for additional charges caused by inaccurate information, carrier adjustments, customer changes, customs requirements, failed delivery, failed pickup, shipment exceptions, or charges assessed by carriers or service providers.
If a recipient, third party, or other paying party fails or refuses to pay any charge, the customer remains responsible for payment.
8. Payment Verification and Refusal of Service
Nowship or the applicable service provider may verify the payment method used for any order or shipment.
Nowship may refuse, cancel, delay, or hold an order or shipment if payment cannot be verified, payment is declined, payment is disputed, the account is not in good standing, or Nowship reasonably believes that payment risk exists.
The customer is responsible for all reasonable costs of collection, including collection agency fees, attorney fees, court costs, interest, and administrative costs, to the extent allowed by law.
9. Dimensional Weight, Weight, and Measurement
Transportation charges may be based on actual weight, dimensional weight, billable weight, carrier measurement, carrier remeasurement, destination rules, service limits, or other rating methods used by carriers or service providers.
If the customer enters incorrect dimensions, incorrect weight, incorrect package count, incorrect destination information, or uses a shipment format outside the approved service limits, the shipment may be delayed, corrected, re-rated, returned, refused, or charged additional fees.
The customer remains responsible for any adjusted charges.
10. Pickup and Delivery
Pickup and delivery are performed by third-party carriers, service providers, or agents.
The customer must have the shipment fully packed, sealed, labeled, accessible, and ready at the scheduled pickup time. If the shipment is not ready, inaccessible, overweight, improperly packed, improperly labeled, located at an inaccessible property, or otherwise unsuitable for pickup, pickup may fail and additional fees may apply.
Delivery may be made to the recipient, another person at the destination, a mailroom, receiving department, building office, campus receiving area, dock, agent location, pickup point, or other location recognized by the carrier or service provider.
Nowship does not guarantee restricted delivery to a specific person unless that service is expressly available, purchased, and confirmed in writing.
11. Transit Times and Delays
Transit times, pickup times, and delivery estimates are estimates only unless a written guaranteed service level applies.
Delays may occur because of carrier operations, weather, customs, holidays, incorrect addresses, missing documents, inspection, security review, remote destinations, equipment issues, labor disruptions, government action, acts of God, emergencies, civil unrest, war, public authority, system outages, routing changes, or other events outside Nowship’s control.
Nowship is not liable for delay-related damages, missed deadlines, lost opportunities, lost profits, inconvenience, emotional distress, reputational harm, business interruption, replacement rental costs, hotel costs, travel costs, or other indirect or consequential damages.
12. International Shipments, Customs, Duties, and Taxes
International shipments are subject to customs clearance, government review, import rules, export rules, destination country rules, carrier rules, and documentation requirements.
The customer is responsible for providing accurate and complete customs information, including item descriptions, values, country of origin, recipient information, identification, inventories, invoices, and any required documents.
Duties, taxes, customs fees, brokerage fees, storage fees, inspection fees, destination charges, penalties, government charges, and return charges are the responsibility of the customer, recipient, or other paying party. If the recipient or third party does not pay, the customer remains responsible.
Nowship is not responsible for customs delays, customs holds, denied entry, seizure, abandonment, inspection, duties, taxes, destination charges, missing documents, inaccurate documents, or failure of the sender or recipient to provide required information.
If a shipment cannot clear customs, cannot be delivered, is refused, or cannot be returned, it may be stored, abandoned, transferred, returned, destroyed, or disposed of according to carrier, customs, government, or service provider rules. The customer is responsible for all related charges.
13. Export Compliance
The customer is responsible for complying with all export, import, sanctions, customs, trade, security, and destination laws.
The customer must not ship to or from restricted parties, sanctioned parties, prohibited destinations, denied persons, blocked persons, or any party or location prohibited by law.
The customer is responsible for any fines, penalties, seizure, delay, return, disposal, legal consequences, or costs caused by non-compliance.
14. Prohibited and Restricted Items
The customer must not ship prohibited, illegal, unsafe, hazardous, restricted, improperly packed, or carrier-restricted items.
Prohibited and restricted items may include, but are not limited to:

Hazardous materials
-
Dangerous goods
-
Explosives
-
Firearms, ammunition, weapons, or weapon parts
-
Illegal substances
-
Drugs, controlled substances, or pharmaceuticals not approved in writing
-
Perishable items
-
Food or beverages requiring temperature control
-
Live animals, insects, plants, or biological materials
-
Human remains, body parts, organs, embryos, or cremated remains
-
Cash, currency, negotiable instruments, securities, or valuable documents
-
Precious metals, precious stones, jewelry, antiques, or high-value collectibles unless approved in writing
-
Pornographic or unlawful material
-
Hazardous waste, medical waste, needles, syringes, or infectious substances
-
Wet, leaking, odorous, contaminated, or unstable packages
-
Packages that require special licenses, permits, temperature control, orientation control, or handling not approved in writing
-
Any item prohibited by the carrier, destination country, origin country, customs authority, or applicable law
Nowship may refuse, hold, cancel, return, dispose of, or reject any shipment that appears to contain prohibited or restricted items. Nowship is not liable for delay, loss, damage, return, disposal, seizure, penalties, or charges related to prohibited or restricted items.
15. Inspection and Refusal
Nowship, carriers, customs authorities, government agencies, brokers, service providers, or security personnel may open, inspect, scan, hold, reject, return, or dispose of shipments without notice when allowed or required by law, carrier rules, safety requirements, customs requirements, or operational need.
Nowship may refuse, cancel, delay, hold, or reject a shipment if:

The shipment may violate law or carrier rules

The shipment may contain prohibited items

The shipment is improperly packed
-
The shipment is overweight or oversized
-
The shipment may damage other shipments, property, equipment, or personnel
-
Payment cannot be verified
-
Required documents are missing
-
The destination is not serviceable
-
The shipment appears unsafe, leaking, unstable, locked, sealed in a way that prevents inspection, or unsuitable for transportation
-
The service requested is not available
Nowship has no liability for refusal, rejection, cancellation, delay, return, or disposal of a shipment under these circumstances.
16. Undeliverable Shipments
A shipment may be considered undeliverable if:

The recipient refuses delivery
-
The recipient refuses to pay duties, taxes, or destination charges
-
The address is incorrect or incomplete
-
The destination cannot be located
-
The recipient is unavailable
-
The shipment cannot clear customs
-
The shipment contains prohibited items
-
The shipment is damaged or leaking
-
The shipment is improperly packed
-
The destination is not serviceable
-
Required documents are missing
-
The shipment cannot be safely delivered
-
The carrier or service provider determines the shipment cannot be delivered
Undeliverable shipments may be returned, stored, abandoned, transferred, held, destroyed, or disposed of according to carrier, customs, government, or service provider rules.
The customer is responsible for all costs related to undeliverable shipments, including return transportation, storage, duties, taxes, disposal, inspection, customs, destination charges, penalties, and administrative costs.
17. Carrier-Provided Value Protection
Value protection, when available, is provided through the carrier or carrier program handling the shipment. Nowship may make value protection available at checkout, help the customer select a protection amount, collect the related charge, and assist with claim submission, but value protection is not a separate insurance product issued by Nowship.
Value protection applies only to eligible shipments, eligible contents, and eligible claims under the applicable carrier rules, service terms, claim requirements, packing standards, exclusions, and documentation requirements.
The customer must select any additional value protection before the shipment enters service. Value protection cannot be added, increased, reduced, credited, refunded, or cancelled after the carrier label has been issued, activated, or the shipment has begun transportation.
The protected amount cannot exceed the actual supported value of the shipment. Proof of value may be required.
Value protection does not cover prohibited items, excluded items, poor packing, insufficient packing, ordinary wear, pre-existing damage, concealed damage unsupported by evidence, sentimental value, delay, customs action, indirect loss, consequential damages, business interruption, loss of data, or unsupported claimed values.
If no additional value protection is selected, the customer accepts the applicable carrier liability limits and any included carrier-provided protection amount stated at the time of purchase.
18. Claims
Claims for damage, shortage, loss, non-delivery, or misdelivery must be submitted promptly and in writing.
Unless a shorter carrier deadline applies, Nowship must receive notice of a claim within 21 calendar days after delivery for damage, visible damage, concealed damage, shortage, or delay. For non-delivery or misdelivery, Nowship must receive notice within 21 calendar days after the shipment was tendered or expected to be delivered.

Repair estimate, replacement documentation, invoice, receipt, appraisal, or other supporting records
The customer and recipient must retain the container, contents, labels, packing materials, and damaged items until the claim is resolved. Failure to retain these materials, provide photos, support inspection, or provide requested documentation may result in claim denial.
Nowship, the carrier, or a service provider may require inspection, retrieval, salvage, or additional documentation before a claim is resolved.
A claim will not be reviewed or paid until all transportation charges, service charges, duties, taxes, and related balances have been paid. Claim amounts may not be deducted from outstanding invoices or charges.
Only one claim may be filed per shipment. Acceptance of claim payment resolves the claim and extinguishes further recovery for that shipment.
19. Limitation of Liability
To the fullest extent allowed by law, Nowship’s maximum liability for any shipment is limited to the lesser of:

The included carrier-provided protection amount stated at purchase;

The additional carrier-provided value protection purchased and approved for the shipment;

The applicable carrier liability limit;
-
The repair cost;
-
The depreciated value;
-
The replacement cost; or
-
$100 if no higher applicable protection amount applies.
Nowship is not liable for indirect, incidental, special, punitive, consequential, emotional, reputational, business, delay-related, customs-related, market-related, data-related, or lost-profit damages.
Nowship is not liable for loss, damage, delay, misdelivery, non-delivery, refusal, seizure, disposal, or additional charges caused by:

Customs action
-
Government action

Carrier action

20. No Household Goods Moving Service
Nowship does not provide full-service household goods moving, in-home packing, in-home loading, furniture moving, furniture disassembly, furniture assembly, appliance servicing, debris removal, unpacking, valuation coverage for household goods moves, or regulated mover services unless expressly stated in a separate written custom service agreement.
Nowship services are shipping-only and are intended for approved self-packed shipments, containerized shipments, packing systems, carrier-provided value protection, and related coordination services.
21. No Freight Forwarder, Broker, or Customs Broker Representation
Unless a written custom service agreement expressly states otherwise, Nowship does not act as the customer’s freight forwarder, customs broker, legal representative, export compliance officer, importer of record, exporter of record, or tax representative.
Any customs, documentation, classification, value, import, export, or compliance guidance provided by Nowship is for general service support only. The customer remains responsible for accuracy, compliance, and approval by the applicable carrier, customs authority, government agency, or service provider.
22. No Warranty
Nowship provides the website, platform, shipment tools, service coordination, containers, and related services as available.
To the fullest extent allowed by law, Nowship makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, uninterrupted service, guaranteed delivery, guaranteed customs clearance, guaranteed carrier performance, or suitability of any shipment for any particular carrier network.
23. Customer Indemnity
The customer agrees to defend, indemnify, and hold harmless Nowship, its owners, officers, employees, contractors, affiliates, service providers, vendors, and partners from any claim, loss, damage, charge, penalty, fine, fee, cost, expense, or liability arising from:

Improper packing

Prohibited or restricted items

Customs violations
-
Export or import violations

Non-payment of duties or taxes

Recipient refusal

Undeliverable shipments

Damage to other shipments, equipment, property, or personnel

Violation of these Terms

Violation of carrier rules

Violation of law
24. Site Credits, Cancellations, and Changes
Returns, credits, partial credits, cancellations, unused containers, unused services, changed bookings, and missed pickups are governed by the Nowship Return, Credit & Cancellation Policy.
Standard bookings are not refundable. Approved remedies are generally issued as site credit or partial credit, not cash refunds, unless Nowship approves otherwise in writing.
Customer-requested changes may result in current rate adjustments, carrier fees, correction charges, cancellation charges, rebooking fees, or loss of credit eligibility.
25. No C.O.D. Service
Nowship does not offer C.O.D. service. Any shipment marked as C.O.D. may be refused, returned, delayed, or handled as an exception shipment. All related charges are the customer’s responsibility.
26. Tracking and Shipment Information
Tracking may be provided by the applicable carrier or service provider. Tracking events, delivery scans, pickup scans, customs events, proof of delivery, and exception notices are generated by third parties and may be delayed, incomplete, unavailable, or inaccurate.
Nowship is not liable for a carrier’s failure to provide complete tracking, proof of delivery, delivery images, pickup confirmation, signature records, or event updates.
27. Electronic Records and Communications
The customer agrees that Nowship may use electronically captured shipment data, order data, website data, carrier data, tracking data, submitted forms, email communications, uploaded documents, and payment records to process orders, coordinate shipments, support billing, review claims, handle customs or compliance needs, and communicate with the customer.
The customer agrees that electronic records may be used for billing, shipment support, claim review, documentation review, and service verification.
28. Changes to Services and Terms
Nowship may update services, pricing, features, service areas, carrier options, policies, and these Terms at any time.
The Terms in effect at the time of booking apply to that order unless a written custom service agreement states otherwise.
Failure by Nowship to enforce any term does not waive Nowship’s right to enforce that term later.
29. Legal Actions
Before filing any legal action, the customer must first comply with all applicable claim, notice, documentation, payment, and review requirements in these Terms and related Nowship policies.
Any legal claim must be brought individually. The customer agrees not to participate as a class representative or class member in a class action against Nowship, to the extent allowed by law.
Any dispute shall be governed by the laws stated in the applicable written agreement. If no written agreement states otherwise, disputes shall be governed by the laws of the jurisdiction where Nowship maintains its principal office, without regard to conflict of law principles.
